  1. Services Provided

The Artist agrees to create the following custom handmade goods as requested by the Client: 

 

– [Detailed Description of Goods, including materials, dimensions, colors, etc.]

 

  1. Payment

Total Price: The total cost for creating your custom item(s) is $[Amount], as agreed between the Client and Artist. 

 

– A non-refundable retainer FEE OF $[Retainer Fee Amount] is required to begin the project and secure your place in the Artist’s schedule

 

– The remaining balance of $[Amount] is due when the project is completed and before delivery or shipping. 

 

– Late Payment: If the final payment isn’t received within [X] days of the completion notice, the Artist may retain the item(s) with the retainer fee being forfeited.

Price includes a 3.3% discount for cash or check payments.

 

  1. Completion Timeline

– The Artist will aim to complete the custom goods by [Completion Date].

 

– Rush Requests: If the Client needs the item(s) finished earlier than the agreed completion date, a rush fee of $30 – $85 per item may apply. This will be calculated based on the amount of work required to meet the new deadline.

 

-with A typical turn around time of 4-6 weeks, orders needing to be completed sooner may be subject to an expedition fee of $25-$45.

 

  1. Shipping and Delivery

– The Artist will arrange delivery or Pickup of the finished goods with the client. Delivery fees will apply and be calculated based on distance. Pickups are free of charge and arrangements will be made when items are ready.

 

– Any shipping costs will be covered by the Client. While the Artist takes care in packaging items securely, she is not responsible for any damage or delays once the item has shipped.

 

  1. Cancellations and Changes

– If the Client needs to cancel the order, this can be done before the project has been started. HOWEVER, if cancelled after fabric has already been processed, the artist is not responsible for replacing any fabric/material.

 

 Please note that the retainer fee* is non-refundable since it covers the time and materials already allocated to your project.

 

– As each item is custom-made, refunds cannot be offered after work has begun, but the Artist will work with you to ensure you’re happy with the final product.

 

  1. Artist’s Rights and Designs

– All designs, techniques, and patterns used by the Artist remain her creative property. The Client is purchasing the handmade item itself and not the rights to reproduce or sell the design.

 

– The Artist may use images of the custom piece for promotional PURPOSES BUT will always seek Client consent if any personal details are included.

 

  1. Limitation of Liability

– The Artist’s responsibility is to deliver a high-quality, handmade product. However, she cannot be held liable for any incidental or indirect issues, like shipping damage or unforeseen circumstances beyond her control. 

– If the Client finds a defect in the handmade item, they must notify the Artist within 14 days of receipt, and the Artist will gladly repair or replace the item, as appropriate.

 

  1. Entire Agreement

– This Agreement represents the full understanding between the Artist and Client, and any changes or additions must be agreed upon in writing.

THIS AGREEMENT IS MADE EFFECTIVE AS OF [DATE] BY AND BETWEEN:

– ARTIST: SHAWNA ATNIP, OWNER OF BITCHIN’ STITCHIN’ BY SHAWNA

&

– CLIENT [CLIENT NAME]

1. SERVICES PROVIDED
THE ARTIST AGREES TO CREATE THE FOLLOWING CUSTOM HANDMADE GOODS AS REQUESTED BY THE CLIENT:

– [DETAILED DESCRIPTION OF GOODS, INCLUDING MATERIALS, DIMENSIONS, COLORS, ETC.]

2. PAYMENT
TOTAL PRICE: THE TOTAL COST FOR CREATING YOUR CUSTOM ITEM(S) IS $[AMOUNT], AS AGREED BETWEEN THE CLIENT AND ARTIST.

– A NON-REFUNDABLE RETAINER FEE OF $[RETAINER FEE AMOUNT] IS REQUIRED TO BEGIN THE PROJECT AND SECURE YOUR PLACE IN THE ARTIST’S SCHEDULE

3. COMPLETION TIMELINE
– THE ARTIST WILL AIM TO COMPLETE THE CUSTOM GOODS BY [COMPLETION DATE].

– RUSH REQUESTS: IF THE CLIENT NEEDS THE ITEM(S) FINISHED EARLIER THAN THE AGREED COMPLETION DATE, A RUSH FEE OF $30 – $85 PER ITEM MAY APPLY. THIS WILL BE CALCULATED BASED ON THE AMOUNT OF WORK REQUIRED TO MEET THE NEW DEADLINE.

-WITH A TYPICAL TURN AROUND TIME OF 4-6 WEEKS, ORDERS NEEDING TO BE COMPLETED SOONER MAY BE SUBJECT TO AN EXPEDITION FEE OF $25-$45.

4. SHIPPING AND DELIVERY
– THE ARTIST WILL ARRANGE DELIVERY OR PICKUP OF THE FINISHED GOODS WITH THE CLIENT. DELIVERY FEES WILL APPLY AND BE CALCULATED BASED ON DISTANCE. PICKUPS ARE FREE OF CHARGE AND ARRANGEMENTS WILL BE MADE WHEN ITEMS ARE READY.

– ANY SHIPPING COSTS WILL BE COVERED BY THE CLIENT. WHILE THE ARTIST TAKES CARE IN PACKAGING ITEMS SECURELY, SHE IS NOT RESPONSIBLE FOR ANY DAMAGE OR DELAYS ONCE THE ITEM HAS SHIPPED.

5. CANCELLATIONS AND CHANGES
– IF THE CLIENT NEEDS TO CANCEL THE ORDER, THIS CAN BE DONE BEFORE THE PROJECT HAS BEEN STARTED. HOWEVER, IF CANCELLED AFTER FABRIC HAS ALREADY BEEN PROCESSED, THE ARTIST IS NOT RESPONSIBLE FOR REPLACING ANY FABRIC/MATERIAL.

PLEASE NOTE THAT THE RETAINER FEE* IS NON-REFUNDABLE SINCE IT COVERS THE TIME AND MATERIALS ALREADY ALLOCATED TO YOUR PROJECT.

– AS EACH ITEM IS CUSTOM-MADE, REFUNDS CANNOT BE OFFERED AFTER WORK HAS BEGUN, BUT THE ARTIST WILL WORK WITH YOU TO ENSURE YOU’RE HAPPY WITH THE FINAL PRODUCT.

6. ARTIST’S RIGHTS AND DESIGNS
– ALL DESIGNS, TECHNIQUES, AND PATTERNS USED BY THE ARTIST REMAIN HER CREATIVE PROPERTY. THE CLIENT IS PURCHASING THE HANDMADE ITEM ITSELF AND NOT THE RIGHTS TO REPRODUCE OR SELL THE DESIGN.

– THE ARTIST MAY USE IMAGES OF THE CUSTOM PIECE FOR PROMOTIONAL PURPOSES BUT WILL ALWAYS SEEK CLIENT CONSENT IF ANY PERSONAL DETAILS ARE INCLUDED.

7. LIMITATION OF LIABILITY
– THE ARTIST’S RESPONSIBILITY IS TO DELIVER A HIGH-QUALITY, HANDMADE PRODUCT. HOWEVER, SHE CANNOT BE HELD LIABLE FOR ANY INCIDENTAL OR INDIRECT ISSUES, LIKE SHIPPING DAMAGE OR UNFORESEEN CIRCUMSTANCES BEYOND HER CONTROL.
– IF THE CLIENT FINDS A DEFECT IN THE HANDMADE ITEM, THEY MUST NOTIFY THE ARTIST WITHIN 14 DAYS OF RECEIPT, AND THE ARTIST WILL GLADLY REPAIR OR REPLACE THE ITEM, AS APPROPRIATE.

8. ENTIRE AGREEMENT
– THIS AGREEMENT REPRESENTS THE FULL UNDERSTANDING BETWEEN THE ARTIST AND CLIENT, AND ANY CHANGES OR ADDITIONS MUST BE AGREED UPON IN WRITING.
